1) Acceptance of Terms

By accessing or using the Site, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Site.

You may use the Site for lawful, informational, and non-commercial purposes related to travel and tourism in and around Mena, Arkansas. You agree not to:

• Violate any applicable law or regulation.
• Interfere with the Site’s operation, security, or integrity (e.g., hacking, scraping at scale, or injecting malware).
• Use automated means to access content except for standard search engine indexing in compliance with our robots rules.
• Misrepresent your identity or affiliation, or submit false or misleading information.
• Infringe any intellectual property or privacy rights.

4) Intellectual Property; License to You

All content on the Site—including text, graphics, logos, photos, videos, data compilations, and software—is owned by or licensed to Visit Mena and protected by U.S. and international intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and display the Site solely for personal, non-commercial use.

Any use not expressly permitted is prohibited. All trademarks, service marks, and logos remain the property of their respective owners.

5) User Submissions & Event Listings

Some areas of the Site may allow you to submit information (e.g., events, attractions, photos, or comments). By submitting, you represent and warrant that you have all necessary rights to the material and that it does not infringe any third-party rights or violate law.

You grant Visit Mena a worldwide, royalty-free, non-exclusive license to use, reproduce, modify, publish, translate, distribute, display, and create derivative works from your submission in connection with operating, promoting, and improving the Site and local tourism initiatives. We may edit, refuse to post, or remove submissions at our discretion.

Event listings are informational only. Inclusion does not constitute endorsement, and we may decline or remove listings without notice.

6) Third-Party Services, Links & Bookings

The Site may link to or embed third-party sites and services (e.g., social media feeds, maps, reservation/ticketing systems, video platforms). We do not control and are not responsible for third-party content, policies, or practices. Your use of third-party services is governed by their terms and privacy policies. Any bookings, purchases, or transactions you make with third parties are solely between you and the third party.

7) Downloads, Forms & Documents

We may provide downloadable documents (e.g., business permits, funding request forms, agendas/minutes). While we strive for accuracy, official requirements may change. Always verify current forms, deadlines, and instructions with the issuing department before relying on a downloaded copy.

8) Outdoor Recreation & Safety Notice

Recommendations for outdoor activities (e.g., hiking, camping, scenic drives) are provided for general information. Outdoor conditions can be hazardous and change rapidly. You are responsible for evaluating conditions, carrying proper equipment, following land-manager rules (e.g., U.S. Forest Service), and exercising good judgment. Visit Mena is not liable for injuries, property damage, or losses arising from outdoor activities described on the Site.

9) Content Accuracy & Availability

We try to keep content current and accurate, but information (including hours, prices, amenities, and events) may change without notice. The Site may be unavailable from time to time due to maintenance or technical issues. We are not responsible for errors, omissions, or downtime.

10) Copyright & Takedown (DMCA)

If you believe content on the Site infringes your copyright, send a notice with sufficient detail to identify the work and the allegedly infringing material, along with your contact information and a statement under penalty of perjury that you are authorized to act, to: pasha@visitmena.com. We may remove content at our discretion and, where appropriate, terminate repeat infringers’ ability to submit content.

Your use of the Site is also governed by our Privacy Policy, which describes how we collect, use, and share information.

12) Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. YOUR USE OF THE SITE IS AT YOUR SOLE RISK.

13) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VISIT MENA AND ITS OFFICERS, COMMISSIONERS, EMPLOYEES, AGENTS, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED ONE HUNDRED U.S. DOLLARS (US$100) OR THE AMOUNT YOU PAID (IF ANY) FOR USING THE SITE IN THE PAST TWELVE MONTHS, WHICHEVER IS GREATER.

14) Indemnification

You agree to defend, indemnify, and hold harmless Visit Mena and its officers, commissioners, employees, agents, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your use of the Site, your submissions, or your violation of these Terms.

15) Suspension & Termination

We may suspend or terminate access to the Site, remove content, or take other appropriate action at any time and for any reason, including violation of these Terms or applicable law.

16) Governing Law & Venue

These Terms are governed by the laws of the State of Arkansas, without regard to its conflict-of-law rules. You agree to the exclusive jurisdiction and venue of the state courts located in Polk County, Arkansas, and the federal courts of the Western District of Arkansas for any dispute arising out of or relating to the Site or these Terms.

17) Changes to the Terms

We may update these Terms from time to time. The “Last updated” date above reflects the latest revision. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
